End User Terms of Use

These End User Terms of Use ("Terms") govern your access to and use of Bougainvillea audio content and related services (the "Service"), provided by Push to Start Ventures LLC ("Company," "we," "our," or "us"), whether accessed at a participating venue ("Partner") or directly through Company. Bougainvillea is a product of Push to Start Ventures LLC. By listening to or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of the Service
Bougainvillea provides streamed, on-demand binaural audio protocols designed to accompany wellness treatments and sessions (for example, IV infusions, facials, or float therapy). The Service is delivered as real-time audio streaming only.
2. License Grant
Subject to your compliance with these Terms, Company grants you a limited, personal, non-exclusive, non-transferable, revocable license to stream and listen to Bougainvillea audio content for your own personal, non-commercial wellness use.
This license does not include, and you receive no right to:
- Download, save, copy, or otherwise store any audio content in any form or format;
- Record, capture, or reproduce audio content through screen recording, audio capture software, virtual audio routing, or any other means;
- Extract, isolate, or separate any layer, stem, or channel of the audio, including the underlying binaural carrier tones;
- Rip, decompile, reverse-engineer, or otherwise attempt to derive the composition, frequency structure, or production technique of any audio content;
- Circumvent, disable, or interfere with any technical measure Company uses to control access to or protect the audio content;
- Redistribute, publicly perform, broadcast, sublicense, rent, lease, or make the audio content available to any third party outside of your own individual listening session;
- Use the audio content, or any portion of it, to train, fine-tune, or evaluate any machine learning or artificial intelligence model;
- Access the Service through automated, bulk, or bot-driven means;
- Block, disable, clear, spoof, or otherwise interfere with any cookie, local storage entry, session token, or similar functional technology the Service uses to maintain a seamless, uninterrupted listening session; or
- Share your account credentials or access link with any other person.
Company reserves all rights not expressly granted in these Terms.
3. Ownership
All audio content, binaural compositions, soundscapes, protocols, associated files, and the technology used to deliver them are owned by or exclusively licensed to Company and are protected by copyright, trade secret, and other applicable intellectual property laws. Nothing in these Terms transfers any ownership interest to you.
4. Access
Access to the Service may be provided on-site at a Partner venue (for example, via venue-provided headphones during a treatment) or through a personal link or account issued by Company. Company or the applicable Partner may limit, suspend, or revoke access at any time, including at the end of a session, appointment, or subscription period.
The Service uses a minimal set of cookies, local storage, and session tokens solely to maintain your listening session and keep playback seamless and uninterrupted — not for advertising or cross-site tracking. These technologies are necessary for the Service to function; interfering with them as described in Section 2 may disrupt your access.
5. Activity Restrictions and Safety Warnings
The Service provides audio protocols, including binaural beats and deep-listening soundscapes, that are specifically designed to induce deep relaxation, altered states of alertness, and drowsiness. Because of these intended effects, do not listen to the Service while driving a motor vehicle, operating machinery, riding a bicycle, or engaging in any other activity that requires your full, unimpaired attention and situational awareness.
Use the Service only in a safe, stationary environment where you can relax without risk of injury to yourself or others. Company and its Partners disclaim all liability for any injury, property damage, or other loss resulting from your use of the Service while driving, operating machinery, or engaging in any activity requiring active attention.
6. Not Medical Advice
Bougainvillea is a wellness audio product. It is not a medical device, medical treatment, or substitute for professional medical care. Nothing in the Service constitutes medical advice, diagnosis, or treatment. Scientific research referenced by Company describes general findings from published literature and does not represent that the Service has been independently validated to produce those specific effects for you individually.
If you have a medical or mental health condition, consult a qualified healthcare provider before using the Service. If you have a history of epilepsy, seizure disorders, or sensitivity to auditory or rhythmic stimulation, consult a physician before use, and discontinue use immediately if you experience discomfort, dizziness, or any adverse reaction.
7. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.
8. Term and Termination
These Terms apply for as long as you use the Service. Company may suspend or terminate your access immediately and without notice if Company reasonably believes you have violated these Terms — in particular, any attempt to download, record, extract, or otherwise circumvent the streaming-only nature of the Service. Termination for cause does not entitle you to any refund.
9. Feedback
If you provide Company with feedback, comments, or suggestions about the Service, you grant Company an unrestricted, royalty-free, perpetual right to use that feedback for any purpose without obligation to you.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. COMPANY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED $100.
12. Indemnification
You agree to defend, indemnify, and hold harmless Company from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of California. Any dispute shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
14. Changes to These Terms
Company may revise these Terms from time to time by posting an updated version. Continued use of the Service after changes constitutes acceptance.
