Terms of Use

These Terms of Use ("Terms") govern access to and use of the website located at bougainvillea.care and any subdomains (the "Site"), operated by Push to Start Ventures LLC ("Company," "we," "our," or "us"). Bougainvillea is a product of Push to Start Ventures LLC. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms govern the Site only — the marketing pages, informational content, and any embedded sample or preview audio. If you listen to Bougainvillea audio protocols as part of a wellness session at a partner venue, or through any account-based access to the product, your use of that audio content is governed by the separate Bougainvillea End User Terms of Use, which are incorporated by reference and control in the event of any conflict with these Terms regarding audio content. If you are a venue, clinic, or practice offering Bougainvillea to your clients, your relationship with Company is governed by a separate Partner Agreement, which controls for any conflict regarding commercial use.
1. The Site
The Site provides information about Bougainvillea's audio wellness product, allows visitors to join a waitlist or request more information, and may include limited sample or preview audio clips for demonstration purposes only. The Site does not itself constitute the licensed Bougainvillea product.
2. Not Medical Advice
Bougainvillea is a wellness audio product. It is not a medical device, medical treatment, or substitute for professional medical care. Nothing on the Site constitutes medical advice, diagnosis, or treatment.
The scientific research referenced on the Site — including material describing binaural beats, awe, frisson, and related auditory phenomena — describes general findings from published, peer-reviewed literature. Citing this research is not a representation that the Bougainvillea product itself has been independently tested or clinically validated to produce these specific effects. These references are provided for informational and educational purposes only.
If you have a medical or mental health condition, consult a qualified healthcare provider before using any wellness product, including Bougainvillea. Individuals with a history of epilepsy, seizure disorders, or sensitivity to auditory or rhythmic stimulation should consult a physician before using binaural audio content.
3. Eligibility
You must be at least 18 years old to use the Site or submit any form on the Site. By using the Site, you represent that you meet this requirement.
4. Sample and Preview Audio
Any audio embedded on the Site for preview or demonstration purposes is provided for streaming playback only, in the same manner and subject to the same restrictions described in Section 5 below. No portion of the Site, including preview audio, may be downloaded, copied, recorded, extracted, or used to create derivative works, except through the ordinary, intended function of a web browser to render the page.
5. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law;
- Attempt to gain unauthorized access to any part of the Site or its infrastructure;
- Reproduce, copy, distribute, publicly perform, or create derivative works from Site content — including text, images, design elements, and any preview audio — without Company's prior written consent;
- Download, capture, record (by screen, audio, or virtual audio device), rip, extract, or otherwise preserve any audio hosted on the Site beyond ordinary streaming playback;
- Reverse-engineer, decompile, or attempt to derive the underlying audio structure, binaural carrier frequencies, or production techniques of any audio content;
- Submit false or misleading information through any form on the Site;
- Use automated means to scrape, index, or systematically extract content from the Site without permission;
- Block, disable, clear, spoof, or otherwise interfere with any cookie, local storage entry, session token, or similar functional technology the Site uses to deliver a seamless browsing and playback experience, or use any browser extension, proxy, or tool designed to strip, alter, or bypass that functionality.
6. Intellectual Property
All content on the Site — including text, images, visual design, audio content and audio descriptions, the underlying audio protocols and binaural compositions, and the Bougainvillea name and marks — is owned by or licensed to Company and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Company's trademarks, logos, audio content, or other proprietary content beyond viewing and streaming the Site in the ordinary course of browsing.
7. Cookies and Functional Technology
The Site uses a minimal set of cookies and similar local technologies (such as local storage and session tokens). These are used strictly to support core site and product functionality — for example, maintaining your session, remembering basic preferences, and enabling smooth, uninterrupted audio playback. As of the Effective Date, Company does not use these technologies for behavioral advertising, cross-site tracking, or building advertising profiles, and does not run a first-party analytics or tracking platform on the Site.
Because these technologies exist to keep the browsing and listening experience seamless rather than to track you, disabling, blocking, or tampering with them may degrade or break site and playback functionality, and doing so through unauthorized means is prohibited under Section 5 above. Third-party services described in Section 8 below may set their own cookies subject to their own policies. For further detail, see Company's Privacy Policy.
8. Third-Party Services
Forms on the Site are processed by Formspree, Inc., subject to Formspree's privacy policy. The Site loads typefaces from Google Fonts, which may cause your browser to contact Google's servers. The Site is hosted on Netlify, subject to Netlify's privacy policy. Company is not responsible for the practices of these third-party services.
9. Forms and Communications
By submitting a waitlist or inquiry form, you consent to receive communications from Company related to Bougainvillea's availability, launch, and related updates. You may opt out at any time by contacting us at hello@bougainvillea.care. We will not use your contact information for unrelated commercial purposes.
10. Third-Party Links
The Site may reference or link to third-party websites and services. Company does not endorse and is not responsible for the content, privacy practices, or accuracy of any third-party site. Use of third-party services is at your own risk and subject to their own terms.
11. Disclaimer of Warranties
THE SITE AND ANY RELATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. COMPANY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED $100.
13. Indemnification
You agree to defend, indemnify, and hold harmless Company and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
15. Changes to These Terms
Company may revise these Terms at any time by posting the updated version on this page with a new effective date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
